SHIPPING :
For orders, shipping and packaging costs are invoiced according to the postal rates in force and according to the carrier chosen by the customer. The amount of shipping costs depends on the weight of the package, its size and the destination, delivery location, your country and your department.
TRANSPORTATION :
Our goods travel at the buyer's risk, despite the retention of title clause, whatever the shipping terms. It is your responsibility to check the condition of the goods upon receipt, and if necessary to engage the responsibility of the carrier, even when the shipment is free of carriage.
PAYMENT :
No package will be sent without prior payment. Payment method: Credit card, Paypal or bank transfer. Payment for your order is made online by credit card, Visa or MasterCard. With this system, your card payment is made directly on the secure server of our bank BNP on our behalf. At no time will your card number be communicated to us. Exchanges are encrypted and secured using the SSL 3 (Secure Socket Layer) protocol on the Internet, a protocol which has become a global standard and which can be used by the main browsers.
PRICE :
Prices are expressed in Euros and do not include shipping costs (unless otherwise stated), invoiced in addition to the price of the products purchased depending on the amount of the order. Shipping costs will be indicated before the buyer registers the order.
Prices are without VAT because we are under the micro-enterprise regime "VAT not applicable article 293 B of the general tax code"
The sales prices of the products may be modified by www.nico-rcshop.com at any time and will be applicable to any order placed after the modification without the previous price being able to be claimed by the Buyer.
We reserve the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any sum due by the buyer, or in the event of payment incident.
In the event of suspicion of fraud, Nico-Rcshop reserves the right to request any proof of identity from the buyer, to carry out any appropriate verification and or to have payment made by transfer, subjecting the execution of the order to the satisfaction of these conditions.
RESERVATION OF PROPERTY :
The goods remain our property until full payment of their amount, even if a payment period is granted.
PRODUCT AVAILABILITY :
All of the products offered are available in stock or to order. However, given the specificity of the products offered, we are not always able to restock from our suppliers. Our offer is therefore within the limit of available stocks and exceptions indicated. Our product database is updated daily. However, the products displayed as available may sometimes no longer be available at the time your order is processed. Consequently, the customer expressly releases “Nico-Rcshop” from all responsibilities due to the constraints cited above. Therefore, if the products ordered are available, your order is processed within 3 working days and delivered within a period not exceeding 15 days depending on the destination. If the products ordered are not available on the day your order is processed but can be restocked, they will be shipped to you as soon as they come into stock. If the products ordered are not available in stock at the time your order is processed and cannot be restocked, we will inform you of the situation by email.
RIGHT TO RETRACT :
The buyer's withdrawal period is extended by www.nico-rcshop.com to 14 days.
The products must be returned to Nico-Rcshop 12 Route d'antony Charles de Gaulle 91320 Wissous in perfect condition for resale, in their original condition, with no trace of use and accompanied by the invoice or contact details of the buyer and complete order references.
Batteries that have already been charged, vehicles that have been used (even 5 minutes) cannot be taken back.
If the product includes a warranty sheet or any other document to be completed, this must not be completed so that the buyer can exercise his right of withdrawal.
Any product that is incomplete, damaged, damaged or whose original packaging has been damaged in such a way that the normal marketing of the product would be affected will not be refunded.
Any risk linked to the return of the product is the responsibility of the Buyer.
Exercising the right of withdrawal will give rise to a refund made by the means used by the buyer when paying for the order after deduction of any delivery costs, with the exception of payments by transfer which will be subject to reimbursement by bank transfer once the buyer has communicated to www.nico-rcshop.com their bank details (IBAN and BIC).
MAJOR FORCE :
Neither party will have failed in its contractual obligations, to the extent that their execution is delayed, hindered or prevented by a fortuitous event of force majeure. Any irresistible fact or circumstance, external to the parties, unforeseeable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts, will be considered as a case of force majeure.
The party affected by such circumstances will notify the other within ten business days of the date on which it becomes aware.
The two parties will then come together, within three months, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which execution of the contract will be continued. If the force majeure lasts longer than one month, these general conditions may be terminated by the injured party.
Expressly, the following are considered as cases of force majeure or fortuitous events, in addition to those which are usually retained by the jurisprudence of French courts and tribunals: the blocking of means of transport, earthquake, fires, storms, flood, lightning, the shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers.
COMPUTER AND FREEDOMS:
Pursuant to Law 78-17 of January 6, 1978, it is recalled that the personal data requested from the Buyer are necessary for the processing of their order and the preparation of invoices, in particular.
The Buyer has, in accordance with national and European regulations in force, a permanent right of access, modification, rectification and opposition with regard to information concerning him.
The information collected by www.nico-rcshop.com during any order is necessary for order management.
As part of the fight against Internet fraud, information relating to the order and payment may be transmitted to persons authorized by law for verification.
